Notice of Privacy and Insurance/Investment Information Practices

Your Privacy is a Top Priority

As a client of our agency, we take this opportunity to both thank you and share with you the importance in which we hold the privacy and confidentiality of your insurance, investment and personal information (hereinafter “nonpublic personal information”). The Bensman Group, as a member of the financial services industry, has been and continues to be subject to applicable federal and state privacy laws regarding the collection and exchange of your nonpublic personal information. In working with you, we gather necessary information from you and other public, insurance and investment sources to execute the insurance/investment market search and placement for the insurance coverage/investments your needs and risk exposures require.

1. Information We Collect
   We collect nonpublic personal information about you from the following sources:
   • Information we receive from you verbally, on applications or on other forms;
   • Information about your transactions with our affiliates, others, or us;
   • Information from medical or other professionals (financial and non-financial); and
   • Information we receive from consumer reporting agencies.
   In doing so, The Bensman Group exchanges such information with other insurance/investment related parties that are similarly obligated under federal and state privacy laws to have in place appropriate procedures to keep all treatments and exchanges of your nonpublic personal information within the requirements of these laws.
   
   
2. Information We May Disclose to Third Parties
   We may disclose all of the information that we collect about you, as described above, so as to serve your insurance coverage and investment needs.
   You do not have a right to opt out of the disclosure of this information.
   
   We will not disclose information about you to anyone except as disclosed in this policy or as permitted by law.
   
   
3. Nonaffiliated Third Parties to Whom Disclosure May Be Made
   Personal information is not disclosed to non-affiliated third parties (meaning any entity other than The Bensman Group and its affiliates listed in Section 4 below) for any reason other than those necessary to provide you insurance and investment services, or at your direction or as required by law. We may disclose nonpublic personal information about you to the following:
   • Financial service providers, such as insurers, investment advisors, broker/dealers, banks, mortgage brokers and leasing companies.
   • Non-financial companies, such as insurance brokers, auto dealerships, accountants, attorneys, independent claims adjusters, appraisal firms, and third party administrators.
   • Others, such as employers (human resources), providers (dentist and doctor offices, hospitals, and other types of caregivers), non-insurance company benefit providers, collection agencies, 401(k) providers and administrators.
   
   
4. Affiliates With Whom Disclosure May Be Made
   We may disclose nonpublic personal information about you to the following third parties affiliated with The Bensman Group and as permitted by law:
   
   • Bensman Risk Management, Inc., a property and casualty insurance agency;
   • Bensman Associates Ltd., a group, life and health insurance agency, wealth management and employee benefits company; and
   • Schemata, LLC, a strategic personal planning company.
   
   
5. Our Practices Regarding Information Confidentiality and Security
   The Bensman Group restricts access to nonpublic personal information about you to those employees who need to know that information in order to provide products or services to you. We maintain physical, electronic, and procedural safeguards to protect the confidentiality of nonpublic personal information that you disclose to us.
   
   
6. Our Policy Regarding Dispute Resolution
   Any controversy or claim arising out of or relating to our privacy information practices, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction.
   
   

Your Rights to Access and Control Your Nonpublic Personal Information

You have the following rights to access and control your nonpublic personal information provided to or collected by The Bensman Group. These rights are important because they will help you make sure that the information we have about you is accurate.
You have the right to inspect and copy any nonpublic personal information that may be used by The Bensman Group for as long as we maintain this information in our records. In order to inspect and/or copy your nonpublic personal information, you must submit a written request, which reasonably describes the information you wish to inspect to:

The Bensman Group may charge you a reasonable fee to cover the costs incurred in providing you a copy of this information. At your request, we will also identify any entities to whom The Bensman Group has disclosed such information within the last two (2) years, and if such disclosures are not recorded in our files, we will identify those companies or individuals to whom The Bensman Group typically discloses such information. We will respond to your request to access your nonpublic personal information within 30 business days from the date we receive it.
If you believe that the nonpublic personal information we have about you is incorrect or incomplete, you may ask to correct the information. You have the right to request a correction for as long as the information is kept in our records. To request an amendment, please write to our President and Chief Operating Officer, Joel Feiger, at the address listed above. Your request should identify the information, which you believe is incorrect, your proposed correction, and the reasons why you think we should make the correction. We will respond to your request within 30 business days of receiving it. If we deny all or part of your request, we will provide a written notice that explains our reasons for doing so. You will have the right to have certain information related to your requested correction included in your records. For example, if you disagree with our decision, you may submit a statement explaining your disagreement and which sets forth what you think is the correct information, which we will include in your records.
